Terms and conditions
Last updated: 23 September 2026
1. Who we are and what these terms cover
These terms and conditions apply to every tour and transfer booked through tour-ghada.com. The provider of this website and the agent is Tour Ghada, Sheraton Road, Hurghada, Egypt, referred to below as „we“.
2. Our role as an agent
We arrange tours and transfers provided by local operators, referred to below as „the operator“. We do not carry out the services ourselves and we are not a tour operator in the sense of package travel law.
A booking creates two legal relationships:
- An agency contract between you and us. What we do is arrange the tour, coordinate the date, organise the pickup and look after you before and after the booking.
- A contract for running the tour between you and the operator. In that we act in the operator's name and on the operator's account.
We tell you which business runs a tour at the latest with your booking confirmation. If you ask, we will tell you beforehand.
3. How a booking comes about
The tours shown on the website are not yet a binding offer. When you complete a booking you make a binding offer. The contract comes about when we confirm the booking by email. The confirmation names the tour, the date, the number of people, the total price, the pickup place, the pickup time and the operator.
An automatic acknowledgement of receipt is not yet an acceptance of the booking.
4. Prices and payment
All prices are in euros and, unless stated otherwise, per person. Child discounts, transfer surcharges and extras are shown on the relevant tour page.
There is no online payment and no prepayment. You pay on site. The method of payment is agreed at pickup or at the end of the tour.
The total in the price calculator on the tour page is non-binding. What counts is the price we confirm to you in writing in our reply to your enquiry.
Beyond the confirmed price, no further costs arise on site unless the tour page marks them explicitly as not included, such as entrance fees, drinks or tips.
5. What is included
What is included in the price is on the page of the relevant tour. What counts is your booking confirmation.
Anything we say about seeing animals, dolphins, turtles or dugongs for example, is not a guaranteed feature. These animals live in the wild and a sighting cannot be promised. Departure and return times are likewise guide values that can shift because of traffic, weather or official checks.
6. Cancellation by you
Up to 24 hours before the confirmed pickup time you can cancel free of charge and the full amount is refunded. After that the full price is due, because the boat, the guide, the entrance fees and the catering have already been ordered by then. For the two-day trip to Luxor with the balloon flight the deadline is 48 hours.
The details are in the cancellation policy, which forms part of these terms.
7. No right of withdrawal for leisure services on a fixed date
For contracts covering services connected with leisure activities that are agreed for a specific date or period, the law provides no right of withdrawal. That applies to our tours and transfers. Instead the cancellation terms under point 6 apply, which let you cancel free of charge up to 24 hours beforehand.
8. Cancellation or change by the operator
A tour can be cancelled if weather, swell, official orders or technical problems make it impossible to run it safely, or if a minimum number of participants stated on the tour page is not reached. In those cases you get the full amount back or move to another date at no cost. There are no further claims, as long as neither we nor the operator are at fault.
Minor changes to the programme, a different snorkelling spot in strong wind for example, remain reserved.
9. What we need from you
Be at the agreed place at the confirmed time. If you do not turn up, the tour counts as used and there is no refund.
Follow the instructions of the captain, the guide and the driver, especially when snorkelling, diving and driving quads and buggies. Anyone who ignores safety instructions after being asked can be excluded from further participation.
10. Health, diving, minimum age
For dives at certified level a valid diving licence has to be shown. If you have health problems, cardiovascular conditions, are pregnant or are taking medication, please get medical advice before booking.
Minimum ages and group sizes are on the page of the relevant tour. Children and young people under 18 can only take part accompanied by an adult.
After diving you have to wait before flying. We recommend putting your last dive at least 24 hours before your return flight.
11. Insurance
We strongly recommend travel cancellation insurance and international health insurance, and for dives a diving accident insurance as well. Insurance is not included in the price.
12. Problems and complaints
If something is not right during a tour, please tell the guide or the captain on the spot straight away, and tell us as well on +20 114 211 4711 or at kontakt@tour-ghada.com. That is the only way the problem can still be fixed during the tour. A later complaint is not affected by this, but it is harder to verify.
13. Liability
As an agent we are liable for selecting and instructing the operator carefully and for properly meeting our own obligations as an agent. The operator is liable for running the tour itself.
We are liable without limit for intent and gross negligence, and for damage arising from injury to life, body or health. In cases of slight negligence we are liable only for breaching essential contractual obligations, meaning obligations whose fulfilment makes proper performance possible in the first place and on whose observance you may rely. In that case liability is limited to the foreseeable damage typical for this type of contract.
These limits do not apply where mandatory statutory provisions require broader liability.
14. Data protection
How we handle your data is set out in the privacy policy. To run a tour we pass your name, the number of people, your hotel and the pickup time to the operator. Without passing that on, the tour cannot be run.
15. Applicable law and place of jurisdiction
Egyptian law applies. If you are a consumer habitually resident in the European Union, the mandatory consumer protection rules of your country of residence continue to apply alongside it; the choice of law does not take that protection away from you (Article 6 of the Rome I Regulation).
16. Final provisions
If any provision is invalid, the remaining provisions stay in force. Changes and additions have to be made in text form.
